1. Scope and seller
These Terms and Conditions apply to orders placed through the online shop at en.diethard-sohn.com. The seller is Diethard Sohn, Leierwiesen 11, 70180 Stuttgart, Germany, email: contact@diethard-sohn.com (“Seller”).
A consumer is a natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader is a natural or legal person or a partnership with legal capacity acting in the course of its trade, business or profession.
2. Offer and conclusion of contract
The presentation of artworks and editions in the online shop is not a legally binding offer. You may place products in the cart and review or correct your entries before submitting the order. By clicking the final order button, you make a binding offer to purchase the products in the cart.
Receipt of the order is confirmed automatically by email. The contract is concluded when we expressly accept the order by email, confirm dispatch or deliver the goods. If the first email already contains an express order confirmation, that confirmation constitutes acceptance.
3. Contract language and contract text
The contract languages are German and English. The order details and these terms are provided with the order confirmation on a durable medium. Registered customers may also view orders in their customer account.
4. Prices, VAT and shipping
All prices shown in the shop are total prices in euros and include German VAT at the current rate of 19%. Additional shipping costs are shown on the product page, in the cart and before the order is submitted.
We currently deliver only within Germany. Editions with acrylic glass are shipped at the flat rate shown at checkout. For safety reasons, editions with mineral glass are available only for collection from the studio in Stuttgart; this is stated clearly for the relevant variation.
5. Payment
The payment methods available at checkout are direct bank transfer and PayPal. For bank transfer, our bank details are provided with the order confirmation and payment is due once the contract has been concluded. PayPal payments are processed by PayPal under its applicable terms.
6. Delivery and collection
The delivery time is stated in the product description or order confirmation. We will inform you without undue delay if delivery is delayed. Where studio collection has been agreed, we will arrange the collection time individually after conclusion of the contract.
7. Retention of title
The goods remain our property until payment has been made in full.
8. Right of withdrawal
Consumers have the statutory right of withdrawal. Details are provided in the separate Cancellation Policy and model withdrawal form.
9. Conformity and defects
Statutory rights in relation to defective goods apply. Minor variations resulting from the artistic or manual production process and differences between a screen display and the original, particularly in colour and surface appearance, do not constitute a defect where they do not affect the agreed characteristics or normal use.
10. Copyright
Purchasing an artwork or edition does not transfer copyright or reproduction rights. Reproduction, publication and commercial use of images require separate permission unless permitted by law.
11. Liability
We remain fully liable for intent and gross negligence and for injury to life, body or health. Otherwise, statutory liability rules apply.
12. Governing law and jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which a consumer habitually resides remain unaffected. Stuttgart is the place of jurisdiction only for merchants, legal entities under public law and special funds under public law.
